Back in 1997 the U.S. Congress called on the Department of Health and Human Services (HHS) to issue patient privacy protections as part of the general provisions of the Health Insurance Portability and Accountability Act of 1996 (HIPAA). While HIPAA encouraged electronic transactions it required advanced safeguards to be in place to protect the security and confidentiality of all personal health care information.
By April 2003, the HHS implemented the first-ever federal privacy standards to protect patients' medical records and health care information. These standards require important assurances that access to one’s medical records and more remain protected at all times, with access controlled for physicians, hospitals, pharmacies, health care insurers and their administration and related support organizations.
